These Terms of Service ("Terms") govern your access to and use of the RefiCompareNow website and the online lender comparison tool made available through it (collectively, the "Site"). The Site is operated by RefiCompareNow ("RefiCompareNow," "we," "us," or "our"), a United States-based online marketing affiliate. Please read these Terms carefully before using the Site.

Acceptance of Terms

By accessing, browsing, or otherwise using the Site, including by submitting information through the online comparison tool, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms in their entirety, you must not access or use the Site.

These Terms constitute a binding agreement between you and RefiCompareNow. We may revise these Terms from time to time as described in the Changes to Terms section below, and your continued use of the Site after any such revision will signify your acceptance of the revised Terms.

Service Description

RefiCompareNow operates as an online marketing affiliate that connects consumers with a network of refinance lenders. The Site provides an online comparison form that consumers may use to request offers from lenders in the network. The information you submit through the comparison form is transmitted to one or more lenders for the purpose of preparing offers for your review.

RefiCompareNow is not a lender, broker, financial advisor, loan originator, or fiduciary. We do not originate loans, take loan applications, hold deposits, set interest rates, underwrite loan products, or make credit decisions. The online comparison form is not a loan application, calculator, or quiz; it is an informational tool used to facilitate the introduction of consumers to lenders in our network.

Each lender in the network evaluates consumer requests according to its own criteria and decides independently whether to extend an offer and on what terms. RefiCompareNow does not guarantee that any lender will make an offer, that any specific terms will be available, or that any request will result in a completed refinance. The availability, terms, and pricing of loan products are determined solely by the lenders, are subject to credit approval and lender terms, and are subject to change without notice.

Eligibility

To use the Site, you must be at least 18 years of age, a resident of the United States, and have the legal capacity to enter into a binding agreement under applicable law. By using the Site, you represent and warrant that you meet these requirements.

If you are using the Site on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to both you individually and the entity. The Site is intended for use only in the United States and is not directed to users located outside of the United States.

Permitted Use

Subject to your compliance with these Terms, RefiCompareNow grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site solely for your personal, non-commercial use in evaluating refinance options.

You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information when using the online comparison form. You agree not to: (i) submit false, misleading, or fraudulent information; (ii) impersonate another person or misrepresent your affiliation with any person or entity; (iii) use the Site to violate any applicable law, regulation, or third-party right; (iv) interfere with or disrupt the operation of the Site or the servers or networks used to make it available; (v) attempt to gain unauthorized access to the Site, other user accounts, or any related systems; (vi) use any robot, spider, scraper, or other automated means to access, monitor, or copy any portion of the Site; (vii) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any portion of the Site, except as expressly permitted by applicable law; (viii) introduce viruses, malware, or other harmful code; or (ix) use the Site in any manner that could damage, disable, overburden, or impair its operation.

We reserve the right to investigate and take appropriate action against any user who, in our sole discretion, violates these Terms, including suspending or terminating access to the Site and reporting unlawful activity to the appropriate authorities.

Not a Lender

RefiCompareNow is not a lender, mortgage broker, or financial advisor. We do not originate loans, hold consumer deposits, take loan applications, make credit decisions, or set the interest rates, fees, or terms of any loan product. All lending decisions, including whether to extend an offer, the rate offered, the term offered, and any associated fees, are made by the lenders in our network in their sole discretion and based on their own underwriting criteria.

Information provided on the Site, including descriptions of refinance product categories, general educational content, and any rate or savings illustrations that may appear, is provided for informational purposes only and does not constitute financial, legal, tax, or other professional advice. You should not rely on the Site as a substitute for professional advice tailored to your individual circumstances. We encourage you to consult a qualified professional and to review each lender's disclosures carefully before making any decision regarding a refinance product.

Disclaimer of Warranties

The Site and all content, features, and services made available through it are provided on an "AS IS" and "AS AVAILABLE" basis, with all faults. To the maximum extent permitted by applicable law, RefiCompareNow and its affiliates, officers, directors, employees, agents, licensors, and service providers expressly disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, RefiCompareNow makes no representation or warranty that the Site or its content will be accurate, complete, current, reliable, uninterrupted, timely, secure, or free of errors, viruses, or other harmful components. Information presented on the Site, including any references to rates, terms, savings, or product features, may not reflect current market conditions or the specific terms a lender may offer to you, and is not guaranteed to be current. Your use of the Site is at your sole risk.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event will RefiCompareNow or its affiliates, officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including, but not limited to, damages for loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, loss of use, or substitute services, arising out of or relating to your access to or use of, or inability to access or use, the Site, even if RefiCompareNow has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the aggregate liability of RefiCompareNow and its affiliates for any and all claims arising out of or relating to these Terms or your use of the Site, whether in contract, tort (including negligence), strict liability, or any other theory, will not exceed one hundred United States dollars ($100). The limitations in this section apply to the fullest extent permitted by law in the applicable jurisdiction; some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless RefiCompareNow and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (i) your access to or use of the Site; (ii) your violation of these Terms; (iii) your violation of any applicable law or regulation; (iv) your violation of any right of any third party; or (v) any information you submit through the Site, including the accuracy of that information.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such matter. You will not settle any claim subject to this indemnification without our prior written consent.

Governing Law

These Terms and any dispute arising out of or relating to these Terms or your use of the Site will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Subject to any mandatory arbitration provision that may be added in the future, you agree that any legal action, suit, or proceeding arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in the State of Delaware, and you irrevocably consent to the personal jurisdiction and venue of those courts.

Changes to Terms

RefiCompareNow reserves the right to modify these Terms at any time at its sole discretion. When we make material changes, we will update the effective date at the bottom of these Terms and, where appropriate, provide additional notice through the Site. It is your responsibility to review these Terms periodically to stay informed of any updates.

Your continued access to or use of the Site after the effective date of any revised Terms constitutes your acceptance of those revised Terms. If you do not agree to a revised version of these Terms, you must stop using the Site.
